1. Who we are
This Privacy Policy explains how personal information is managed in connection with ifeelgood 24/7 Oxenford.
In this Privacy Policy, “ifeelgood 24/7 Oxenford”, “we”, “us” or “our” means:
- CBK Enterprise Investments Pty. Ltd. ABN 96 611 545 763, the operator of the ifeelgood 24/7 Oxenford club at 9/160 Old Pacific Highway, Oxenford QLD 4210; and
- where it operates the ifeelgood 24/7 network website or shared systems and handles the relevant information, ifeelgood 24/7 Australia Pty Ltd ABN 56 145 747 815.
Each entity is responsible for the personal information it handles.
This Privacy Policy applies to information collected through the ifeelgood 24/7 website, Oxenford landing pages and forms, membership and booking systems, email, SMS, telephone, social media, the Oxenford club and related services.
Where they apply, we manage personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We manage commercial email and SMS under the Spam Act 2003 (Cth), and telemarketing under applicable Do Not Call Register and telecommunications requirements.
2. The information we collect
Depending on how you interact with us, we may collect:
- your name, date of birth, age, gender and contact details;
- your address, identification details and emergency contact details;
- membership, attendance, class, booking and access records;
- information about enquiries, free trials, offers, competitions, purchases and services;
- payment and direct debit details, usually processed and stored by our payment providers;
- health information, medical conditions, fitness assessments, goals and other sensitive information reasonably needed to provide services safely;
- CCTV footage, photographs, video, entry logs and other security or safety records;
- communications with us, including emails, SMS messages, enquiries, feedback, complaints and calls where recording has been disclosed;
- marketing preferences and evidence of consent, including the consent wording shown, date and time, source form or page, phone number or email address and relevant technical records;
- technical and usage information, including IP address, device and browser information, pages viewed, referring source, cookies, pixels and analytics data; and
- other information you choose to provide or that we are required or authorised by law to collect.
If you provide information about another person, such as an emergency contact, you must have their permission or another lawful basis to do so.
3. How we collect information
We may collect personal information:
- directly from you through forms, conversations, memberships, bookings, assessments, visits and communications;
- automatically when you use our website, online forms, app, Wi-Fi or digital services;
- from the ifeelgood 24/7 franchise network and service providers involved in operating our services;
- from a parent or guardian, referrer, emergency contact or authorised representative;
- from social media platforms, advertising platforms, competitions, promotions or lead forms where you submitted your information; and
- from public or third-party sources where collection is lawful.
Where practical, you may interact with us anonymously or using a pseudonym. We may need accurate identifying information to provide membership access, process payments, respond to safety issues or meet legal obligations.
4. Why we collect, use and disclose information
We may use or disclose personal information to:
- respond to enquiries and provide information about the Oxenford club, memberships, trials, classes, offers and services;
- establish, administer and support memberships, bookings, payments, direct debits and club access;
- provide fitness services, personal training, challenges, classes and member support;
- protect the health, safety and security of members, visitors, staff and property;
- communicate account, booking, access, payment, safety and service information;
- send marketing where we have consent or another lawful basis, and manage marketing preferences and opt-outs;
- personalise and improve services, advertising, website performance and customer experience;
- conduct analytics, research, administration, record keeping, training and quality assurance;
- investigate complaints, prevent fraud, recover debts and enforce agreements;
- comply with legal obligations and respond to regulators, courts or law enforcement; and
- manage a business transfer, restructure or professional advice process.
We will only collect sensitive information, including health information, with consent unless the law permits or requires otherwise. We will not use sensitive information for direct marketing without consent.
5. Email, SMS and direct marketing
We may send communications about enquiries, memberships, appointments, club services, events, promotions and offers.
Marketing emails and SMS messages will only be sent where we have the consent required by law or another lawful basis. Providing a mobile number by itself does not automatically subscribe you to ongoing marketing SMS.
If you opt in to marketing SMS:
- messages will identify ifeelgood 24/7 Oxenford;
- message frequency varies;
- message and data rates may apply;
- you can reply STOP to unsubscribe or HELP for help;
- consent is not a condition of purchasing a membership or service; and
- we keep reasonable records of the consent provided.
You can unsubscribe from marketing:
- from SMS by replying STOP or making any other clear request to stop;
- from email by using the unsubscribe link or replying with an unsubscribe request; or
- by contacting us using the details in section 15.
We action electronic marketing unsubscribe requests as soon as practicable and no later than five working days. We do not charge a fee, require extra personal information, or require you to log in or create an account to unsubscribe.
Opting out of marketing does not prevent us from sending non-commercial messages reasonably necessary to manage an existing membership, payment, booking, access request, safety issue or service you requested. You can contact us to discuss communication preferences.
For telemarketing, we comply with applicable calling-time, caller-identification, consent and Do Not Call Register requirements. If you ask us to stop a marketing call or withdraw consent, we will do so.
6. Mobile information and consent data
We do not sell mobile phone numbers or SMS consent data.
We do not share mobile phone numbers, SMS opt-in information or SMS consent records with third parties or affiliates for their own marketing or promotional purposes.
We may disclose this information to service providers solely to operate our communications, membership or customer service systems, or where disclosure is required or authorised by law. Those providers may only use the information to provide services to us, not for their own marketing.
7. Who we disclose information to
We may disclose relevant information to:
- ifeelgood 24/7 network entities and clubs where needed to provide network membership access or services;
- membership management, booking, access-control and class management providers, including GymMaster where used;
- customer relationship management, email, SMS, telephone and customer support providers;
- payment processors, direct debit providers, banks and debt recovery providers;
- website hosting, IT, cloud storage, cybersecurity and data analytics providers;
- advertising and analytics providers, including Google and Meta where used;
- CCTV, security, maintenance and facility providers;
- personal trainers, contractors and staff who need the information to provide services;
- professional advisers, insurers, auditors and regulators;
- a prospective purchaser or successor in connection with a business transaction; and
- courts, law enforcement or other recipients where required or authorised by law.
We do not sell personal information or disclose it to unrelated third parties for their own direct marketing.
8. Overseas disclosure and storage
Some technology and service providers may store or process information outside Australia, including in the United States and other countries in which their systems, related companies or subcontractors operate.
Where Australian privacy law applies, we take reasonable steps required by law in relation to overseas disclosures. Because provider locations may change, you can contact us for current information about material overseas disclosures.
9. Cookies, analytics and advertising
Our website may use cookies, pixels, tags and similar technology to:
- operate forms and website features;
- remember preferences;
- measure website use and campaign performance;
- improve content and services; and
- deliver or measure advertising, including through Google and Meta where used.
These technologies may collect device, browser, IP address, page-view, interaction and referring-source data. You can restrict cookies through browser or device settings, although parts of the website may not work as intended. Where consent is required for a particular technology, we will seek it.
10. CCTV, access and facility safety
The Oxenford club may use CCTV and electronic access records for safety, security, incident investigation, access management and protection of people and property. Notices will be displayed where appropriate.
Footage and access records are only accessed by authorised people and may be disclosed to insurers, security providers or authorities where reasonably necessary or required by law.
11. Children and young people
Membership and access by people under 18 is subject to the club’s membership rules and any required parent or guardian involvement. We may collect information about a young person from them and their parent or guardian where reasonably necessary to assess eligibility, provide services safely and administer membership.
12. Security, retention and data breaches
We use reasonable technical, physical and organisational safeguards to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.
No transmission or storage system is completely secure. If a data breach occurs, we will investigate and take appropriate action. Where the Notifiable Data Breaches scheme applies and a breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required.
We retain information only for as long as reasonably needed for the purposes described in this Privacy Policy, to meet legal, accounting and operational obligations, or to establish or defend legal claims. We then securely delete or de-identify it where lawful and practical.
13. Access and correction
You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.
There is no charge to make a request. Where permitted by law, reasonable costs may apply to providing access. We will explain any proposed cost in advance. We may need to verify your identity and may refuse access in circumstances permitted by law, in which case we will provide reasons where required.

If you believe we have mishandled your personal information, contact us with enough detail to investigate. We will acknowledge the complaint, investigate it fairly and aim to respond within 30 days.

Part 2: Website and Messaging Terms of Service
1. About these terms
These Terms of Service apply when you use the ifeelgood 24/7 Oxenford website or landing pages, submit an enquiry, use an online form, or opt in to our SMS or email program.
In these Terms, “ifeelgood 24/7 Oxenford”, “we”, “us” or “our” means CBK Enterprise Investments Pty. Ltd. ABN 96 611 545 763, the operator of the ifeelgood 24/7 Oxenford club at 9/160 Old Pacific Highway, Oxenford QLD 4210.
The ifeelgood 24/7 network website may also be operated by ifeelgood 24/7 Australia Pty Ltd ABN 56 145 747 815.
By using the website or submitting a form, you agree to these Terms. If you do not agree, do not use the website or submit information through it.
2. Memberships, trials, offers and club rules
Memberships, free trials, promotions, challenges, classes, personal training and other paid services may have additional eligibility rules, prices and terms shown in the relevant offer, membership agreement or club rules.
These Website and Messaging Terms do not create a gym membership and do not replace:
- the membership agreement;
- any direct debit authority;
- the club rules;
- specific promotional terms; or
- any health screening, waiver or consent required for a service.
If there is an inconsistency, the specific offer or signed agreement applies to that service, subject to rights that cannot be excluded by law.
Prices, inclusions, availability and promotion dates may change. The terms shown when you accept an offer or enter an agreement will apply. Nothing on a general webpage guarantees that a particular membership, price, class, trainer or service is available.
3. Information and eligibility
You must provide information that is accurate, current and not misleading. You must not submit another person’s details without their authority.
If you are under 18, a parent or guardian may need to approve your membership or participation in accordance with the club’s membership rules.
4. Health and fitness information
General content on the website, in messages or on social media is for information only. It is not medical advice, diagnosis or a substitute for advice from an appropriately qualified health professional.
Exercise involves risk. Before using fitness services, you must disclose relevant health risks as required by the membership agreement and club rules, follow safety instructions, use equipment appropriately and seek professional advice where needed.
Nothing in these Terms excludes obligations or rights that cannot lawfully be excluded.
5. SMS program
5.1 What messages may include
Depending on the consent you provide and your relationship with us, messages may include:

- club news, events and customer care messages; and
- marketing about memberships, promotions, challenges and related services.
5.2 How you opt in
You may opt in through a clearly labelled website checkbox, written or verbal consent recorded by us, an SMS keyword, or another method that clearly explains the messaging program.
Submitting a phone number for a specific enquiry allows us to respond to that enquiry. It does not by itself subscribe you to unrelated or ongoing marketing SMS.
Marketing SMS consent is voluntary and is not a condition of purchasing a membership or service.
5.3 Frequency and charges
Message frequency varies depending on your interactions, bookings, membership and marketing preferences.

5.4 How to opt out or get help
Reply STOP to an SMS to unsubscribe from marketing SMS. You can also make any other clear request to stop by replying to a message or contacting us.
We action marketing opt-outs as soon as practicable and no later than five working days. After an opt-out, we may send one non-promotional confirmation that the request has been processed.

Withdrawing marketing consent does not cancel a gym membership or stop non-commercial messages reasonably necessary to manage a membership, booking, payment, access issue, safety matter or service you requested.
5.5 Delivery and phone-number responsibility
Mobile carriers and messaging providers are not responsible for delayed or undelivered messages. Delivery is not guaranteed and may be affected by network availability, filtering, device settings or an incorrect number.
You confirm that you are authorised to use the mobile number you provide. Tell us if the number changes or is reassigned.
5.6 SMS privacy
We do not sell or share mobile phone numbers, SMS opt-in information or SMS consent records with third parties or affiliates for their own marketing or promotional purposes.
We may provide this information to service providers solely to operate our communications, membership or customer service systems, or where required or authorised by law.
6. Email and telephone marketing
Marketing emails will identify the sender and contain an unsubscribe facility. You can unsubscribe using the link in an email, by replying with an unsubscribe request or by contacting us. We action requests as soon as practicable and no later than five working days.
We only make telemarketing calls where permitted. Callers will identify themselves and the reason for the call, comply with applicable calling times, end the call if asked, and respect withdrawn consent and Do Not Call Register requirements.
7. Acceptable use
You must not:
- use the website unlawfully, fraudulently or to harm another person;
- interfere with the website’s security, operation or availability;
- introduce malicious code or attempt unauthorised access;
- scrape, copy or commercially exploit website content without permission;
- impersonate another person or submit false information; or
- use our communication channels to send abusive, discriminatory, threatening or unlawful content.

We aim to keep the website available and information accurate, but we do not promise uninterrupted access or that every item is complete or current. 11. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, we are not liable for indirect or consequential loss arising only from use of, or inability to use, the website. Any liability that can lawfully be limited is limited to the extent permitted by law.
12. Changes to the website, messaging program or Terms
We may change the website, suspend or end a messaging program, or update these Terms. The current Terms will be published with their effective date.
A change will not retrospectively remove rights already accrued under law or a signed agreement. If a change requires renewed consent, we will seek it.
13. Governing law
These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts with jurisdiction in Queensland, subject to any rights to bring a claim elsewhere that cannot be excluded.

Part 3: SMS and Marketing Communications Policy
1. Scope
This SMS and Marketing Communications Policy explains how ifeelgood 24/7 Oxenford obtains and manages consent for marketing by SMS, email and telephone, what communications you may receive, and how you can withdraw consent.
This Policy forms part of our Privacy Policy and Website and Messaging Terms of Service above.
2. Types of communications
Depending on your request, consent and relationship with us, we may contact you about:
- an enquiry, membership application or free trial you submitted;
- appointments, tours, orientations, bookings and class reminders;
- membership, account, payment, access and customer service matters;
- club news, events, challenges and service updates;
- membership options, promotions, special offers and related fitness services;

- safety, security or operational matters affecting the club or your membership.
